Our Salary Partner Anja Hillig analyzes a landmark decision of the Court of Justice of the European Union (CJEU) in the field of data protection and digital services law in the current issue of the legal journal European Economic and Tax Law.

In its Russmedia decision(C-492/23, Grand Chamber, 2 December 2025), the CJEU addresses how online marketplaces and other platforms that (i) host user-generated content and (ii) are (jointly) responsible under data protection law must comply with their data protection obligations.

In addition to summarizing the Court’s reasoning, Anja Hillig places the judgment in the broader context of liability privileges for hosting providers and their responsibilities under data protection law.
