WIPIT Know-How: Expanded obligations for platform operators under the GDPR

Our Salary Partner Anja Hillig analyzes a landmark ruling by the Court of Justice of the European Union (CJEU) regarding data protection and digital services law in the latest issue of the legal journal "Europäisches Wirtschafts- und Steuerrecht." In its Russmedia decision (C-492/23, Grand Chamber, December 2, 2025), the CJEU clarified how online marketplaces and other platforms that host user-generated content and bear (joint) responsibility under data protection law must fulfill their obligations. In addition to summarizing the grounds for the decision, Anja Hillig contextualizes the ruling within the framework of liability privileges for host providers and their responsibilities under data protection law.
